SPOUSAL SUPPORT

Spousal support, often referred to as alimony or maintenance, addresses the financial support provided from one spouse to another after a separation or divorce. It aims to alleviate potential financial disparities that can arise when one spouse has a higher income or greater financial resources than the other.


The primary purpose of spousal support is to assist the economically disadvantaged spouse in maintaining a reasonable standard of living post-separation. It acknowledges the contributions made during the marriage, both financial and non-financial, and seeks to prevent undue financial hardship on the lower-earning spouse.


Factors that influence spousal support determinations may include:

  1. Duration of Marriage: Longer marriages may lead to greater spousal support, reflecting the duration of shared financial responsibilities.
  2. Financial Disparity: Spousal support aims to bridge the financial gap between the higher-earning and lower-earning spouse.
  3. Income and Earning Capacity: Courts consider the income and potential earning capacity of each spouse, along with their ability to maintain their own financial independence.
  4. Contributions to the Marriage: Non-financial contributions, such as homemaking or supporting the other spouse's career, can influence the determination of spousal support.
  5. Health and Age: The health and age of both spouses can impact their ability to earn a living and support themselves.
  6. Standard of Living: The lifestyle maintained during the marriage may be a factor in determining the appropriate level of spousal support.
  7. Custody and Child Care: If one spouse takes on primary custody of the children, this can affect the need for and amount of spousal support.


Spousal support arrangements can be temporary, rehabilitative (to help a spouse acquire education or training for self-sufficiency), or permanent, depending on the circumstances of the marriage and the needs of the parties involved.
